ANNUAL FERPA NOTIFICATION
Family Educational Rights and Privacy Act (FERPA)
The Family Educational Rights and Privacy Act (FERPA) affords students certain rights with respect to their education records. Further details may be found in Policy and Procedures under the Family Educational Rights and Privacy Act (FERPA) and at www.ed.gov/policy/gen/reg/ferpa/index.html
These rights include:
The right to inspect and review the student’s education records within 45 days of the day the Institute receives a request for access. Students should submit to the Program Manager of their department, written requests that identify the record(s) they wish to inspect. The Program Manager of the department will make arrangements for access and notify the student of the time and place where the records may be inspected.
The right to request an amendment of the student's education records that the student believes is inaccurate or misleading. Students may ask the Institute to amend a record that they believe is inaccurate or misleading. They should write the Program Manager of their department, clearly identify the part of the record they want changed, and specify why it is inaccurate or misleading. If the Institute decides not to amend the record as requested by the student, the Institute will notify the student of the decision and advise the student of his or her right to a hearing regarding the request for amendment. Additional information regarding the hearing procedures will be provided to the student when notified of the right to a hearing.
The right to consent to disclosure of personally identifiable information contained in the student's educational records, except to the extent that FERPA authorizes disclosure without consent. FERPA allows schools to disclose those records, without consent, to the following parties, or under the following conditions (34CFR~99.31):
•School officials with legitimate educational interest**
•Other schools to which a student is transferring
•Specified officials for audit or evaluation purposes
•Appropriate parties in connection with financial aid to a student
•Organizations conducting certain studies for or on behalf of the school
•To comply with a judicial order or lawfully issued subpoena
•Appropriate officials in cases of health and safety emergencies
•State and local authorities, within a juvenile justice system, pursuant to specific State law
** A school official is defined as a person employed by the Institution in an administrative, supervisory, academic, or support staff position (including law enforcement unit and health staff); a person or company with whom the Institution has contracted (such as an attorney, auditor, or collection agent); a person assisting another school official in performing his or her tasks.
A school official has a legitimate educational interest if the official needs to review an educational record in order to fulfill his or her professional responsibility.
Disclosure of Directory Information. Flagler Technical Institute has designated the following categories of information as "directory" information: student's name, address(es), telephone number(s), email address(es), date and place of birth, previous educational institution(s), program of study, enrollment status, anticipated graduation date, honors and awards, photographic/digital/video images and dates of attendance. This information will be subject to public disclosure unless a student requests in writing to prevent disclosure of directory information.
